This is a translation. The French version prevails.
These terms govern the use of the Heverly apps (Heverly CRM, and soon Heverly Marketing) by the businesses that subscribe to them. They supplement Heverly Studio's general terms.
Who we are
The apps are provided by Mathyssa Dorsainvil Potier, sole trader operating as Heverly Studio, 60 rue François 1er, 75008 Paris, France (RCS Paris 884 699 596). Contact: contact@heverlystudio.com.
The service
Heverly CRM is online software for appointment-based businesses: client records, scheduling, online booking, memberships, quotes, invoices, payments, messages and leads. It works on computers and phones, with a personal account.
The apps are for professional use only (businesses and self-employed people), for their business.
Your account
- Each team member has their own access. Keep your credentials confidential; you are responsible for what is done with your business's accounts.
- Tell us immediately about any unauthorised access.
- To help you during setup or support, Heverly Studio may act within your workspace. Each intervention is recorded in the workspace activity.
Plans, prices and payment
- Plans, prices and inclusions are those shown on our website or in the offer given at subscription. Prices exclude VAT where VAT applies.
- Setup: payable on signing, unless the offer states otherwise.
- Subscription: monthly with no commitment (cancel any month), or yearly paid in advance. Periods already started are not refunded.
- Trial period: depending on the plan. At the end of the trial, the subscription continues unless cancelled before it ends.
- SMS: included SMS are stated in each plan. Beyond that, they are charged at the stated price, up to the monthly cap you choose.
- If payment is late, we may suspend access after an unanswered reminder. Data is kept during suspension.
Your responsibilities
- You use the apps lawfully, in particular regarding your own clients' data: you inform them and, where the law requires it, obtain their consent (for example for marketing SMS or emails).
- The legal information on your invoices and quotes (company numbers, VAT, mandatory statements) is what you enter: you remain responsible for it. We recommend having your settings checked by your accountant.
- In some countries (for example Italy, Spain or Portugal), the law requires certified invoicing software. Heverly CRM is not certified and must not be used there as official invoicing software.
- You do not use the apps to send unsolicited messages or unlawful content, or to try to access other customers' data.
Connected services
At your request, the apps can connect to external services (for example Facebook and Instagram to receive your leads, an SMS provider, tools such as Make or Zapier). Their use remains subject to their own terms, including Meta's. You can disconnect these services at any time.
Your data
- The data you store remains yours. You can export it at any time from the settings.
- We process it only to provide the service, as explained in the app privacy policy.
- After the subscription ends, you have 30 days to export your data. It is then deleted.
Availability
We do our best to keep the apps available at all times and your data protected. Interruptions may still occur, especially for maintenance or if a provider fails. We give advance notice of major maintenance where possible.
Liability
Our liability is limited to direct, proven damage and capped at the amount paid for the subscription over the last 12 months. We are not liable for indirect damage (loss of revenue, customers or data due to misuse), nor for external services you connect.
Termination
- You can cancel at any time, effective at the end of the current period.
- We may terminate or suspend an account for serious breach of these terms, after notifying you, except in urgent cases (security, unlawful activity).
Changes
We may change the apps and these terms. For significant changes, we notify you at least 30 days in advance. If you disagree, you can cancel before they take effect.
Governing law
These terms are governed by French law. In the event of a dispute, we will first seek an amicable solution. Failing that, the courts of Paris will have jurisdiction.
